Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Bonjur.ai (the "Service"), operated by Bonjur.ai ("we," "us," "our"), available at https://bonjur.cc/. By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Definitions
- "Service" means the Bonjur.ai AI call-center platform, including its web application, APIs, and telephony/voice-AI features.
- "User" or "you" means the individual or organization that registers for and uses the Service.
- "Customer Org" means a business entity that creates an account to use the Service to handle its own phone calls and customers.
- "End-Caller" means an individual who calls or is called through a Customer Org's use of the Service, and who is not themselves a User.
3. User Accounts & Responsibilities
- Account creation. You must provide accurate, current information when creating an account and keep it up to date.
- Password security. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
- Prohibited activities. You agree not to use the Service to: send spam or unsolicited communications in violation of applicable law; attempt to hack, disrupt, reverse-engineer, or gain unauthorized access to the Service or other users' data; or engage in any illegal, fraudulent, or harmful activity.
- AI-calling responsibilities. If you use the Service to place, receive, or record phone calls, you are solely responsible for: obtaining any consent required to record or process calls under applicable wiretapping/recording law; complying with telemarketing, robocall, and AI-voice-disclosure laws (including, without limitation, the U.S. Telephone Consumer Protection Act and similar state and international laws) for any calls placed or received through the Service; and disclosing the use of an AI agent to End-Callers where required by law.
4. Intellectual Property
- Our content. The Service, including its software, design, text, graphics, and the "Bonjur.ai" name and logo, is owned by us or our licensors and protected by intellectual property law. Nothing in these Terms grants you rights in our trademarks or branding beyond what is necessary to use the Service.
- Your content. You retain ownership of content you upload to the Service (e.g., knowledge-base documents, call recordings, configuration data) ("User Content"). You grant us a limited license to host, process, and transmit User Content solely to provide and operate the Service on your behalf. You represent that you have the necessary rights to upload and process your User Content, including any End-Caller data it contains.
5. Limitation of Liability & Disclaimers
- Pilot / beta service. The Service is currently offered as a pilot program still in active testing. Features, availability, and functionality may change, be interrupted, or be discontinued without notice. The Service is not yet warranted to be production-stable, and you should not rely on it for critical or time-sensitive operations without your own contingency plan.
- "As-is" service. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- No uptime guarantee. We do not guarantee the Service will be uninterrupted, timely, secure, or error-free, including with respect to third-party telephony and AI voice providers the Service depends on.
- Liability cap. To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
6. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ends, though certain provisions of these Terms (including intellectual property, liability limitations, and governing law) survive.
7. Governing Law
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.
